According to HMRC, 48% of private institutions who care for the elderly are acting in breach of the National Minimum Wage Regulations. This is not surprising as there are many possible pitfalls which can trip employers up. Some of these were discussed at the Employment Law Update Seminar on 4th November with speakers from law firm EMW. For example, did you know that it is a breach of the regulations to make deductions for the cost of uniforms and other items connected to an individual's employment if that takes the individual's earnings below the national minimum wage level for that payment reference period? Being found to be in breach of the National Minimum Wage regulations can impact upon a care home both financially and in terms of its reputation, so it is important to act correctly.
